Biography

Adam Polk, Partner at Girard Sharp, has established himself as a leading advocate for plaintiffs in complex litigation, consistently delivering exceptional results in all aspects of civil litigation, from initial case investigation and complaint preparation through trial and settlement. Respected among his peers for his leadership, preparation, and client-centered decision-making, Adam’s practice encompasses a range of class action matters, including securities & financial fraud, consumer privacy & defective products, sexual abuse, and catastrophic injury.

Throughout his career, Adam has achieved remarkable results for his clients across various practice areas. His successful resolutions include a shareholder case against Maxar Technologies Inc. that resolved for $36.5 million, the In re Nexus 6P Products Liability Litigation and Weeks v. Google LLC consumer class actions against Google that resolved for a combined $17 million, and the In re Sears Holdings Corporation Stockholder and Derivative Litigation that resulted in a $40 million settlement.

Adam has extensive experience in securities and financial fraud litigation, where he currently serves as co-lead counsel in several high-profile cases. These include a case alleging Hewlett Packard misled investors during its merger with Computer Science Corporation to form DXC Technology Company, a shareholder case against Huntington Bancshares Inc. alleging violations of the Securities Act of 1933, and a significant class action against Illumina, Inc. that also asserts Securities Act claims.

A key focus of Adam’s practice is technologically complex litigation on behalf of consumers, where he leads several significant matters, including the Lakeview Loan Servicing Data Breach Litigation, representing over 2.5 million individuals whose personal and financial information was compromised, and In re Accellion Data Breach Litigation, a case following the theft of sensitive information from Accellion’s File Transfer Appliance system. He also serves as co-lead counsel in litigation against Delta Dental concerning the exposure of sensitive consumer data and as lead counsel in the Microsoft and PayPal Browser Extension Litigations, representing content creators and marketers in claims of commission diversion through unauthorized tracking.

In catastrophic injury matters, Adam recently served as a key member of the trial team in In re Pacific Fertility Center Litigation, securing a landmark jury award of $15 million for the loss of four families’ eggs and embryos and a global resolution with the tank manufacturer for dozens of other hopeful parents.

Adam is active in the American Bar Association, where he serves as the current co-chair of the ABA’s National Institute on Class Actions and co-chair of the Virtual Programming Board. He also serves as a leader of the American Association for Justice’s Class Action Litigation Section, where he is the chair elect.

Adam was recognized as a National Trial Lawyers Top 40 Under 40 every year since 2019 and was included in their Top 100 Civil Plaintiff Lawyers list in 2024. He was also named to Best Lawyers’ Ones to Watch list in 2021 and 2022 and honored in 2022 as a Rising Star of the Plaintiffs Bar by the National Law Journal. In 2023, 2024, and 2025, he was named one of Lawdragon’s 500 Leading Consumer Plaintiff Lawyers. He has been selected by his peers as a Northern California Super Lawyer and a Rising Star every year since 2013.

Browser Extension Litigations

Serves as lead counsel representing content creators and marketers in both In re Microsoft Browser Extension Litigation and In re PayPal Honey Browser Extension Litigation, two cases against digital platforms alleging commission diversion through browser extensions.

In re Pacific Fertility Center Litigation
Represented individuals and families as interim class counsel and sole liaison counsel in this case alleging that a tank holding plaintiffs’ eggs and embryos failed, compromising the viability of their genetic material. Recovered $15 million settlement for four families and a global resolution with the tank manufacturer for dozens of other hopeful parents.

In re Accellion, Inc. Data Breach Litigation

Representing plaintiffs in a class action lawsuit against Accellion regarding a major data breach, presenting key arguments on standing and class certification before U.S. District Judge Edward J. Davila.

In re Illumina, Inc. Shareholder Litigation

Serves as co-lead counsel in this biotech sector class action alleging board fiduciary breaches.

In re Lakeview Loan Servicing Data Breach Litigation

Serves as lead counsel, representing over 2.5 million individuals whose personal and financial information was compromised in this data breach.

Allergan Biocell Textured Breast Implant Products Liability Litigation

Served as an Executive Committee member in this class action against Allergan following product recall arising out of reports that certain Allergan BIOCELL© breast implants may cause anaplastic large cell lymphoma (“BIA-ALCL”), a cancer of the immune system.

In re Maxar Technologies, Inc. Shareholder Litigation

Served as co-lead counsel and helped secure final approval of a $36.5 million settlement in the Maxar securities litigation, where plaintiff alleged that Maxar, a satellite manufacturer, issued false and misleading materials to shareholders during its acquisition of DigitalGlobe, a satellite imaging company.

In Re HPE Enterprise Services-DXC Technology Co. Merger Litigation

Serves as a member of co-lead counsel in the DXC securities class action lawsuit alleging that HPE and DXC made misleading and false statements in offering materials prior to HPE’s acquisition of Computer Sciences Corporation, Inc. (CSC) and subsequent merger to create DXC

In re Nexus 6P Products Liability Litigation
Serves as co-lead counsel in this consumer electronic product liability case against Google and Huawei arising out of their allegedly defective Nexus 6P smartphones.

Weeks et al. v. Google, LLC
Serves as co-lead counsel in this smartphone products liability case arising out of Google’s allegedly defective Pixel and Pixel XL smartphones.

In re Sears Holdings Corporation Stockholder and Derivative Litigation
Represented nominal plaintiff Sears in derivative litigation alleging breaches of fiduciary duty arising out of Sears’s spinoff of several of its real estate assets into a newly formed REIT. Recovered $40 million on behalf of Sears.

Daccache v. Raymond James Financial, Inc. et al. 
Represented investors in the Jay Peak EB-5 immigrant investor program in this case alleging that Raymond James aided and abetted a fraud resulting in more than $350 million in losses. Recovered $150 million on behalf of investors to date.
