Biography

Andrew Kaufman is a skilled and polished writer and oral advocate with ten years of experience representing plaintiffs in complex mass torts and class actions. He currently serves as Co-Chair of the Law & Briefing Committee in the multidistrict litigation against Uber on behalf of passengers sexually assaulted by drivers. Previously, Mr. Kaufman was co-lead of Law & Briefing for the bellwether team in the Juul multidistrict litigation that tried a school district case against Altria (the parent company of Philip Morris), resulting in a $235 million settlement after the plaintiff rested its case. He also led the briefing teams defending several historic verdicts on behalf of smokers in the Florida Engle litigation. He represented injured municipalities, native American tribal entities, and third-party payors in the McKinsey opioid litigation, including navigating complex issues of preclusion and municipal authority, resulting in nationwide settlements. He played key roles in landmark class actions, including serving as class counsel in the Kona coffee litigation that protected the hardworking farmers of the Kona region of Hawaii by prosecuting Lanham Act claims against alleged manufacturers and sellers of fake Kona coffee. Before joining Girard Sharp, Mr. Kaufman was a partner at a national Plaintiffs’ firm and clerked on the Sixth Circuit and the District of Columbia Court of Appeals.

  • In re Uber Technologies Passenger Sexual Assault Litigation (current) – Co-Chair of Law & Briefing Committee in multidistrict litigation on behalf of thousands of passengers sexually assaulted by Uber drivers.
  • In re JUUL Labs, Inc. Marketing, Sales Practices, & Products Liability Litigation – Represented young people injured by Juul vaping products, an economic injury class, government entities, school districts, and Native American tribes alleging the companies’ conduct in the marketing, design, and distribution of the Juul e-cigarette contributed to a youth vaping epidemic. The case resulted in global settlements against Juul Labs and Altria (the parent company of Philip Morris).
  • Corker v. Costco Wholesale Corp., Inc., et al. – Represented farmers of authentic Kona coffee against manufacturers and retailers of allegedly generic coffee falsely labeled as Kona. The case resulted in a series of class action settlements totaling more than $122 million in cash and injunctive relief. The Court described class counsel, including Mr. Kaufman, as conducting one “of the most impressive class action cases I have dealt with in my time on the federal bench,” adding that the results in the litigation were “great for justice” because this was a case with “a real result that makes people whole again.”
  • Story v. Heartland Payment Systems, LLC – Represented parents who paid allegedly unlawful transaction fees when adding money to their schoolchildren’s lunch accounts. The case resolved on a class basis, court approval pending.
  • Nashville Gen. Hosp. v. Momenta Pharms., et al. – Represented public hospital and union benefit fund in antitrust class action against major pharmaceutical companies. The case settled for $120 million, at that time the second largest indirect-purchaser antitrust settlement in history.
  • In re Navistar, Inc. Marketing, Sales Practices, and Products Liability Litigation – Represented diesel truck owners in multidistrict class action litigation regarding allegedly defective engines. The case settled for $135 million.
  • In re Engle Cases – Represented smokers and their families defending trial verdicts on appeal. Successfully briefed or argued in defense of more than $100 million in verdicts.
