In the pending Subaru Battery Drain Litigation, where Girard Sharp serves as co-lead counsel, plaintiffs scored a victory on March 31 when the District Court preserved several of their causes of action.
Plaintiffs allege that the battery system in certain Subaru vehicles is defective, and that as a result of the defect, numerous owners and lessees have experienced unanticipated and sometimes hazardous vehicle failures. Plaintiffs seek to represent a class of similarly situated owners and lessees of the Subaru vehicles in question.
In its recent 67-page opinion, the New Jersey District Court upheld several of Plaintiffs’ claims under state warranty and consumer fraud laws.
