On February 12, 2019, plaintiffs filed a motion for preliminary approval of a class action settlement with the University of Southern California, its board of trustees, and Dr. George Tyndall, and an accompanying motion to appoint a special master to oversee the settlement administration process. The Court held a hearing on the motions on April 1, 2019. The Court concluded the hearing by indicating to the parties that the Court intended to deny plaintiffs’ motions and would issue an order to explain the Court’s reasoning. The Court issued its order on April 18, requiring that the parties provide additional information and suggesting several modifications to the settlement. Daniel Girard commented, “We appreciate the Court’s direction and look forward to addressing the Court’s concerns as expressed in the order. The settlement gives every single woman who saw Tyndall a choice in how she wants to participate and hold USC accountable, while also forcing the school to change to ensure this doesn’t happen again. We are confident it will ultimately be approved.”
