U.S. District Judge Haywood S. Gilliam, Jr. on June 18 denied Uber’s attempt to force a consumer plaintiff to drop his class action claims against Uber and proceed individually in private arbitration.
Our client—the consumer plaintiff—alleges that Uber violated the Telephone Consumer Protection Act (TCPA) by flooding his cell phone with unwanted text messages even after he asked Uber to stop texting him.
Given the plaintiff’s testimony that he did not recall signing up for Uber, Judge Gilliam found a genuine dispute of fact as to whether the plaintiff ever agreed to Uber’s arbitration clause. So the plaintiff’s class action claims will now proceed in federal court.
