The case, which arose from allegations that Meta’s tracking tools captured sensitive reproductive health data from users of the Flo menstrual app, marks a pivotal moment in privacy litigation against Big Tech.
Polk, who regularly litigates CIPA cases against technology companies, provided expert commentary on the verdict’s significance:
“The verdict shows that there’s significant liability for companies that engage in this type of behavior. It also tells me that everyday Americans are not okay with this.”
He added that the outcome also highlights the limitations of blanket user consent as a defense:
“It’s one thing to consent, for example, to a fist fight,” he said. “But that’s not the same thing as consenting to a fight where one party is using brass knuckles.”
