Girard Sharp LLP and its co-counsel filed a motion on May 10 seeking approval of a proposed $7.25 million settlement of a class action lawsuit against Google concerning the first-generation Pixel and Pixel XL smartphones. The plaintiffs allege that Pixels manufactured before January 4, 2017 have a defect that leads to microphone or speaker failures.
The case is pending before U.S. District Judge Nathanael Cousins in San Jose, California. A hearing is scheduled for June 5, 2019 to determine whether to grant preliminary approval to the settlement, approve notice to the proposed class, and schedule a final approval hearing.
The settlement would benefit a class comprised of all persons in the United States who purchased a Pixel or Pixel XL smartphone, other than for resale, before January 4, 2017 and did not receive a replacement Pixel manufactured after January 3, 2017 or refurbished after June 5, 2017. Because the settlement has not yet received preliminary approval, the claims period has not begun.
