Partner Scott Grzenczyk will be presenting at this year’s Class Actions and Mass Torts Regional CLE Program in Chicago, presented by the Litigation Section of the American Bar Association. The event takes place June 17, 2022. Scott will be one of two experts on a panel entitled “Litigating Price Premium Claims in Consumer Class Actions.” The panel will focus on the Supreme Court’s decision in Comcast Corp. v. Behrend and subsequent case law that has made clear that a plaintiff in a consumer class action must show how they will prove class-wide injury with common evidence in a manner that is consistent with the theory of liability asserted. To meet this burden, the class action plaintiff bar has employed various techniques, including surveys and conjoint and regression analyses. The panel will discuss the current state of the law, commonly used damages models, and plaintiff and defense side strategies.
