On May 24, 2021, before the Hon. Jacqueline Scott Corley, in one of the Northern District of California’s first in-person civil jury trials since the Covid19 pandemic, trial opened against cryogenic tank manufacturer Chart Industries, Inc. over the failure of a cryopreservation tank in March 2018, which destroyed and damaged the embryos of Pacific Fertility Center patients. In April 2018, one month after the tank failure, Chart issued a recall of several cryopreservation tanks, citing reports of problems with a “vacuum leak.”
In her opening statement, as reported by Reuters, partner Dena Sharp said that evidence would show the tank’s faulty design resulted in a catastrophic loss of liquid nitrogen, and that Chart knew of defects in the tank before the incident.
